Finance Ministry Introduces New Norms for Handling Delayed Tax Refund Claims

The Ministry of Finance has unveiled comprehensive guidelines to improve the management of delayed tax refund claims and loss carry forward applications. Aimed at minimizing bureaucratic delays, particularly for taxpayers who missed filing their income tax returns (ITR) yet have refunds due, these guidelines introduce a tiered authority system along with specific time limits.

Crux of the Guidelines

The new circular from the Central Board of Direct Taxes (CBDT) outlines a structured approach for handling condonation of delay applications. Key points include:

  • No Higher Authority Required: Taxpayers will not need to approach higher authorities for increasing refund amounts.
  • Five-Year Time Limit: A strict five-year limit has been imposed for filing condonation applications.

Tiered Authority Structure

Claim AmountProcessing Authority
Claims Up to ₹1 CrorePrincipal Commissioners of Income-tax (Pr. CsIT/CsIT)
Claims Between ₹1-3 CroreChief Commissioners of Income-tax (CCsIT)
Claims Above ₹3 CrorePrincipal Chief Commissioners of Income-tax (Pr. CCsIT)

Time Limits and Conditions

  • Five-Year Limit: Claims must be filed within five years from the end of the assessment year, applicable to all claims filed after October 1, 2024.
  • Court-related Refunds: Court proceedings will be excluded from this five-year limit, and applications must be submitted within six months of the court order or the end of the financial year, whichever is later.
  • Supplementary Refund Claims: These can be filed under certain conditions, but no interest will be paid on late claims.

Streamlined Processing and Reduced Hurdles

Authorities are required to dispose of refund applications within six months of receipt. This initiative aims to build trust, ensure timely refunds, reduce taxpayer intervention, and enhance compliance.

Rebate Structure for Vehicle Buyers

The government has introduced a rebate structure to encourage the purchase of cleaner vehicles, with the following details:
